Welcome to Hello Marshy. These Terms of Service ("Terms") govern your access to and use of the Hello Marshy website, mobile applications, and services (collectively, the "Platform") operated by Hello Marshy Inc. ("Hello Marshy," "we," "us," or "our").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.
Hello Marshy is an online marketplace that connects pet owners ("Owners") with independent pet care providers ("Sitters"). Hello Marshy is not a pet sitting service. We provide the technology platform that enables Owners and Sitters to find each other, communicate, and arrange pet care services. We do not employ, supervise, direct, or control Sitters or the services they provide.
All pet care arrangements are made directly between Owners and Sitters. Hello Marshy is not a party to any agreement between an Owner and a Sitter, and we do not guarantee the quality, safety, or legality of any services provided through the Platform.
THIS SECTION CONTAINS AN IMPORTANT LIMITATION OF LIABILITY. PLEASE READ IT CAREFULLY.
You acknowledge and agree that pet care inherently involves risks, including but not limited to property damage, personal injury, pet injury, pet illness, pet escape, and pet death. By using the Platform to arrange pet care services, you voluntarily assume all risks associated with such arrangements.
Pet Owners are solely responsible for adding booking protection for each and every booking made through the Platform. Optional booking protection (Marshy Cares) is available at checkout. Hello Marshy strongly recommends that all Owners add protection for every booking, but the decision to do so is entirely the Owner's responsibility.
Failure to add booking protection means the Owner assumes full financial responsibility for any damages, losses, injuries, or liabilities arising from the booking.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HELLO MARSHY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, CLAIMS, INJURIES (TO PERSONS OR PETS), PROPERTY DAMAGE, OR ANY OTHER LIABILITY OF ANY KIND ARISING FROM OR RELATED TO:
YOU EXPRESSLY WAIVE AND RELEASE HELLO MARSHY FROM ANY AND ALL LIABILITY, CLAIMS, CAUSES OF ACTION, OR DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR ANY PET CARE SERVICES ARRANGED THROUGH IT.
You agree to indemnify, defend, and hold harmless Hello Marshy, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Platform, any pet care services you arrange or provide, or your violation of these Terms.
You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
You must notify us immediately of any unauthorized use of your account. Hello Marshy is not liable for any loss or damage arising from your failure to protect your account credentials.
Sitters are independent contractors and are not employees, agents, or representatives of Hello Marshy. Sitters are solely responsible for determining how they provide their services, setting their own schedules, and complying with all applicable laws and regulations. Nothing in these Terms creates an employment, partnership, or agency relationship between Hello Marshy and any Sitter.
All Sitters must complete identity verification and a background check through our third-party screening partner before they can accept bookings. Sitters are responsible for a one-time $35 verification fee. While Hello Marshy requires background checks, we do not guarantee the accuracy or completeness of background check results and are not liable for any acts or omissions of verified Sitters.
Sitters may subscribe to listed monthly or yearly plans to maintain their active listing on the Platform. Membership fees, features, and terms are described on our pricing page.
Membership plans may automatically renew unless cancelled before the next renewal date. Hello Marshy may change membership fees, plan features, or plan availability on notice to Sitters.
All payments on the Platform are processed through Stripe, our third-party payment processor. By using the Platform, you agree to Stripe's terms of service and privacy policy.
For Owners:Owners pay the sitter's listed rate plus standard Stripe payment processing fees. Hello Marshy does not charge any additional service fees to Owners.
For Sitters: Sitters keep 100% of their earnings from bookings. Hello Marshy does not take any commission on pet care services. Sitters pay membership fees for their listing plan and a one-time verification fee.
All amounts are in Canadian dollars unless otherwise indicated on the Platform. You are responsible for any taxes applicable to payments you make or receive through the Platform.
Cancellation terms are established between the Owner and Sitter at the time of booking. Hello Marshy recommends that Owners and Sitters agree on cancellation terms before confirming a booking.
For membership cancellations, Sitters may cancel their membership at any time. Cancellation takes effect at the end of the current billing period, and no refunds are provided for partial billing periods.
The one-time verification fee of $35 is non-refundable once the background check process has been initiated.
Membership fees are non-refundable except where required by law.
Owners authorize Sitters to obtain veterinary care for a pet in the event of illness, injury, or emergency during a booking if the Owner cannot be reached in time. Sitters should use reasonable efforts to contact the Owner first where circumstances permit. Unless otherwise agreed between the Owner and Sitter, the Owner remains responsible for all veterinary costs and related expenses. Hello Marshy is not responsible for any veterinary decisions, treatment, or costs arising during or after a booking.
Owners must provide accurate, current, and complete information about each pet when creating a profile, requesting a booking, or communicating with a Sitter. This includes any behavioural issues, bite history, aggression, medical conditions, medications, vaccination status where applicable, special care needs, escape risks, and any other information that may affect the health, safety, or handling of the pet during a booking.
Owners are solely responsible for updating this information promptly if anything changes. Hello Marshy is not responsible for any loss, damage, injury, or claim arising from incomplete, inaccurate, or omitted pet information provided by an Owner.
When using the Platform, you agree not to:
The Platform and its original content, features, and functionality are owned by Hello Marshy Inc. and are protected by copyright, trademark, and other intellectual property laws. Our trademarks, logos, and service marks may not be used without our prior written consent.
By posting content on the Platform (including profile information, photos, and reviews), you grant Hello Marshy a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute such content in connection with operating and promoting the Platform.
Disputes between Owners and Sitters are between those parties. Hello Marshy may, but is not obligated to, assist in resolving disputes.
Any dispute, claim, or controversy between you and Hello Marshy arising out of or relating to these Terms or the Platform shall be governed by the dispute resolution process set out in these Terms and, where necessary, resolved in accordance with applicable law. Nothing in these Terms limits any rights that cannot be waived under applicable law.
We may suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform immediately ceases. Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to the liability waiver, indemnification, and dispute resolution sections.
You may delete your account at any time by contacting us at contact@hellomarshy.com.
In no event shall Hello Marshy's total liability to you for all claims arising from or related to the Platform or these Terms exceed the amount you have paid to Hello Marshy in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is less.
In no event shall Hello Marshy be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, regardless of the theory of liability.
These Terms, and any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, or the Services, shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Subject to any dispute resolution procedures set out in these Terms and any rights that cannot be excluded under applicable law, the parties submit to the non-exclusive jurisdiction of the courts of Ontario, Canada.
Nothing in these Terms limits or excludes any non-waivable rights or protections a user may have under applicable consumer protection, privacy, or other mandatory laws of the jurisdiction in which they reside.
By using the Platform, you agree to receive communications from Hello Marshy electronically, including by email, through the Platform, or by other electronic means. You agree that any notices, disclosures, agreements, and other communications that Hello Marshy provides electronically satisfy any legal requirement that such communications be in writing.
Hello Marshy reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
